COOKIES POLICY

§1 General provisions

1. The owner of the Shop/Site and the Controller of personal data provided during the use of the Site and/or the Online Shop maintained at exflo.pl is EXFLO Sp. z o.o., ul. 3.The Site and/or the Shop uses cookies to provide services and features tailored to the preferences and needs of the Site Users, in particular cookies allow the Site to recognise the User’s device and display the Site accordingly, tailored to the User’s individual needs.

4. Cookies can be temporary, i.e. they are deleted when the browser is closed, or permanent.

5. Permanent cookies are also stored after finishing browsing the Site’s pages and are used to store information such as password or login, which makes it quicker and easier to use the pages, as well as to remember the User’s selected settings.

6. The purposes of using cookies on the Site/in the Shop and access to them by other entities are indicated later in this document.

7. The information is processed in accordance with the currently applicable legislation, i.e. the Act of 12 July 2024 on Electronic Communications Law, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the GDPR), as well as the Data Protection Act of 10 May 2018.

§2 Definitions

1. Cookies – small files downloaded to and stored on the User’s computer or other device, linked to information about how the Site is used.

2. Personal data – any information that, without unreasonable time and cost, can lead to the identification of a natural person, including their identification, address and contact details.

3. Third country – a country outside the European Economic Area (EEA).

4. Site – the website available at https://exflo.pl/, through which the User can browse the content of the website, subscribe to the newsletter or contact the Data Controller using the contact details or forms available on the website.

5. Shop– the online shop available at https://exflo.pl/sklep/ where the Buyer may purchase certain Goods and/or Digital Products.

6. User/data subject – a person who voluntarily uses the services and content available on the Site and/or Shop, i.e. browses the Site and Shop pages, places an order in the Shop, registers, subscribes to a free newsletter or contacts the Shop owner via contact form.

7. End User – an entity using or requesting a publicly available electronic communications service to meet its own needs. The User/data subject may also be an End User.

§3 Purposes for storing and accessing the information contained in cookies.

1. The Site uses cookie files for the following purposes:

  • adapting the content of the Site’s pages to individual User preferences and optimising the use of websites (tailored display – functional cookies);
  • make analyses and prepare statistics which will provide information on how the Site User uses the pages, mprove their structure and content;
  • marketing and/or remarketing, including the targeting of dedicated content, in particular to Users who have visited the website or Fanpage of the Data Controller on Facebook and/or Instagram.

2. The data contained in the cookies will be archived and used for statistical analysis and evaluation of the Site’s global user traffic.

3. The data contained in the cookies is not combined with the personal data provided by the User when concluding and/or performing a contract or contacting the Data Controller.

§4 Tools used to collect cookies or share cookies.

To analyse the traffic on the Site, the source of traffic, as well as to optimise marketing activities, the following are installed on the website:

1. Google Analytics – a tool provided by Google LLC. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, which allows the analysis of User traffic on the Site and its sub-sites (country/city, number of visits, pages viewed, visit length, etc.).

The main cookie used by Google Analytics, “_ga”, enables the service to distinguish between individual Users and remains active for 2 years. Each “_ga” file is unique to a specific service, therefore it cannot be used to track a user or browser on other, unrelated websites.

To permanently block the cookies collected by Google Analytics, the User can use the browser add-on developed and provided by Google LLC at: https://tools.google.com/dlpage/gaoptout

2. Google Ads – an advertising tool provided by Google LLC. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, allowing placement of ads in Google search engine, as well as conversion and remarketing tracking in conjunction with cookies collected by Google Analytics.

3. Facebook Pixel – tool provided by Meta Platforms, Inc., Menlo Park, California/Meta Platforms Ireland Limited (formerly: Facebook Inc.), which enables the measurement, optimisation and creation of customised audiences, allows collection of information on the User’s activity on the Website and the targeting of dedicated content to the User on the Facebook social network. To control your privacy settings on this social network, you may change your preferences and settings at any time. More information at: https://www.facebook.com/privacy/ Facebook Pixel allows creation of custom audiences and/or similar audiences to individuals who have already interacted with the Site or with the Data Controller’s materials made available on Facebook and/or Instagram social networks operated by the Data Controller, whereby the retention of data provided by Facebook Pixel in particular being respectively:

  1. website (Site) – a maximum of 180 days after interaction with the website;
  2. Facebook fanpage – a maximum of 365 days from interaction with the account;
  3. video shared on the Controller’s Facebook fanpage – a maximum of 365 days from interaction with material;
  4. events organised or co-organised by the Controller on the Facebook fanpage – a maximum of 365 days from interaction with the material.Facebook Messenger/Instagram – a tool provided by Meta Platforms, Inc., Menlo Park, California/Meta Platforms Ireland Limited (formerly: Facebook Inc.) which allows the User to contact the owner of the Site via Messenger on Facebook/Instagram. The use of Facebook chat on the Site is voluntary. The User can send messages as a guest or log in to their account on this site. More information at: https://www.facebook.com/privacy/

4. Facebook/Instagram plug-in/widget – a tool allowing the User to go directly to the Data Controller fanpage hosted on the Facebook/Instagram social networking site, provided by Meta Platforms, Inc., Menlo Park, California/Meta Platforms Ireland Limited (formerly: Facebook Inc.). While on Facebook and Instagram Users are additionally subject to the privacy policies described therein, in particular at: https://www.facebook.com/privacy/

5. YouTube plug-in/widget – enables the User to go to the YouTube channel – hosted by the Data Controller on that site. The tool provided by Google LLC. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, whose Users are additionally subject to the privacy policy described on this site, in particular at: https://policies.google.com/privacy

6. Linked plug-in/widget – enables the User to go to LinkedIn and the professional profile maintained on that site by the Data Controller, provided by Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-7329 USA. Users are additionally subject to the privacy policy described on this site, in particular at: https://pl.linkedin.com/legal/privacy-policy

7. MailerLite sign-up form – cookies that enable the sign-up form to be displayed on the site and the subscriber to sign up for the site’s newsletter, saving cookies (mailerlite_classic_session), provided by MailerLite Limited, Ground Floor, 71 Lower Baggot Street, Dublin 2, D02 P593,

8. Hotjar – an analytical tool provided by Hotjar Ltd, Dragonara Business Centre, 5th Floor, Dragonara Road,, Paceville St Julian’s STJ 3141, Malta, for the analysis of traffic and activities performed on the Shop’s website by the User. Allows the tracking of the User’s movement on the site and its recording (_hjSessionUser_* – to store a unique user ID, validity period of 1 year).

§5 Processing of information contained in cookies outside the EEA.

1. The processing of data contained in cookies by providers whose headquarters and/or servers are located in a third country will involve the transfer of this information outside the European Economic Area (EEA), in particular the user’s IP address and/or information about the pages visited.

2.The transfer of data contained in the cookies to the United States of America (USA), is based on the European Commission’s decision of 10 July 2023 stating an adequate level of data protection provided by the so-called “EU-US Data Privacy Framework” in relation to providers listed by the US Department of Commerce, such as: Google LLC. 1600 Amphitheatre Parkway Mountain View, CA 94043, USA; Meta Platforms, Inc., Menlo Park, California, USA; Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-7329 USA.

§6 Accepting, rejecting or changing cookie settings.

1. Upon accessing the Site and/or the Shop, the User may accept the use of cookies for the above purposes, reject them or consent only to selected cookies.

2. The User, in accordance with Article 399(2) of the Act of 12 July 2024 on Electronic Communications Law, may give consent by means of settings of the software installed in the telecommunications terminal equipment used by the User or the configuration of the service.

3. The User’s consent to the installation, storage and provision of cookies is voluntary. Consent may be revoked at any time. The User may at any time delete and/or deactivate cookies in the web browser that they use to browse the Site/Shop or select the appropriate Site/Shop cookie settings through tools or other functionalities for managing cookies on the Site/Shop provided by the Site/Shop owner for this purpose.

4. To manage cookies, the User can use the functions available in the browser they are currently using. Instructions for the management of cookies are available on the websites of the web browser providers, in particular:

5. 6. Electronic service providers may install software on or use software in the subscriber’s or end user’s telecommunications terminal equipment intended for the use of those services, provided that the subscriber or end user:

    1. prior to the installation of the software, is informed directly, in an unambiguous, easily understandable manner, of the purpose for which the software will be installed and how the service provider will use the software;
    2. is informed directly, in an unambiguous, easily understandable manner, about how to remove the software from the user’s telecommunications terminal equipment;
    3. agrees to the installation and use of the software before installing it.

7. Deleting or disabling cookies may cause difficulties or limited functionality in some parts of the Site and/or Shop (applicable to functional cookies). This is due to the fact that some cookies may be necessary for the proper functioning of the pages of the Site, including remembering the User’s settings and/or displaying content on the particular type of device the User is using.

§7 Final provisions.

In the event that the current Cookie Policy is modified, in particular if the technical solutions used or changes to the law on User privacy so require, appropriate modifications will be made to the above provision, which will take effect 14 days after publication on the Site/Shop.
